IACA constitution situation
Dear Presidents,
The previous experience over the years proves that it is almost impossible, to find a general agreement over the text of our Constitution.
In our opinion it was therefore correct to appoint an international Task-Force for the Constitution updating. This has been done and the new document produced may be considered a good work, suitable to manage the International Class in the next years.
The procedure to change the old Constitution, dated 1997 is the “Ballot”, and in a Ballot only the individual Financial Fleet Members decide!
Ballot is a “democratic” system but also a very expensive and time consuming procedure, and we think that the Class needs to improve its responsiveness and capability to coordinate and act together Members, National Associations, ISAF and Sailing Clubs/Organising Committee.
In very few words we must find a way to coordinate the sailing activity worldwide and we need to use means suitable for this purpose.
As you know the new Constitution did not reach the majority of 2/3 of voting members. The unique point of discussion was Art. 8.1 – Voting rights.
Now this point has been changed even if the aim to increase the power of smaller National Associations has been saved.
8.1 At a WGM each National Association may exercise its voting right based upon the notification and payment to I.A.C.A. of the previous calendar year fee per registered Fleet Members (paying and honorary members) or for the newly accepted National Associations within the same WGM, as per the following ratio:-
1-5 members = 1 vote; 6-11 members = 2 votes; 12-18 members = 3 votes; 19-25 members = 4 votes; 26-33 members = 5 votes; 34-42 members = 6 votes; 43-51 members = 7 votes; 52-61 members = 8 votes; 62-72 members = 9 votes; 73-83 members = 10 votes; 84-95 members = 11 votes; 96-108 members = 12 votes; 109-121 members = 13 votes; 122-135 members = 14 votes; 136-150 members = 15 votes; more than 151 members one vote every 15 additional members.
The Returning Officer of the Ballot procedure, Mr. Dieter Melcher, will keep in touch with the members who opposed.
If a 2/3 approval is reached among these members within one month the updated I.A.C.A. Constitution will be approved.
Our target is to have the new Constitution approved or not within June .
If not a new ballot will be done.
